This End User License Agreement is a binding legal agreement between you and Pixieset Media Inc. Purchase, installation or use of any WordPress theme provided on Flothemes signifies that you have read, understood, and agreed to be bound by the terms outlined below.
1. Theme Licensing & Use
All Flothemes WordPress themes are licensed under the GNU General Public License. You have the right to use each purchased Flothemes theme on one domain only. You are authorized to make any necessary modification(s) to Flothemes themes to suit your needs.
1.1 License Reselling
Reselling the license of any Flothemes products is strictly prohibited. We hold the right to cancel any licenses if these terms are breached.
2. Theme Updates
All themes are consistently tested and updated to be compatible with the latest stable version of WordPress. However, we can give no guarantee that current versions of Flothemes themes will be compatible with previous versions of WordPress, or that previous versions of themes will be compatible with the current or future versions of WordPress. While theme license is for life for one time purchases, theme’s lifespan is guaranteed for up to 18 months from official creation release date, which is noted on product page. Flothemes reserves the right to discontinue a theme without prior notice. Theme owners of discontinued or/and not supported themes are not eligible for upgrades, free switches or guaranteed exclusive discounts.
3. Theme Delivery
As soon as your payment has fully cleared, you will receive an email containing a download link. Use this link to download your Flotheme right away. If you do not receive your download link within 2 hours of your purchase please feel free to contact us by clicking “Contact” at the top of Flothemes.
4. Use of Content
You acknowledge that the site contains or may contain material (collectively the “Content”) which is protected by copyright, trademark or other proprietary rights; therefore, you are only permitted to use the material as expressly authorized by Flothemes (Pixieset Media Inc.). You may not transfer or sell, reproduce, distribute, or in any way exploit any of the content, in whole or in part, except with an expressly permitted agreement from Pixieset Media Inc.
5. Refund Policy
Flothemes is offering non-tangible digital goods. We offer refunds within 90 days from purchase, Flothemes will process a refund not including third-party transaction fees from the original payment, ie. Stripe, or fees related for a refund to be processed, ie. PayPal. Flothemes reserves the right to analysis each refund request on a case by case study.
6. Refund Policy for Installations
We are unable to refund users on installation packages as soon as the installation form has been submitted. Please take time to consider the need for an installation package before you decide to purchase an installation package, remember they can be purchased after the initial theme purchase.
7. Installation services Time terms
Installation services purchased are valid for 3 months from purchase. Failure to start your process after this period may be subject to repurchase or a new setup fee.
8. Warranty
Flothemes WordPress themes are provided “as is” without warranty of any kind, either expressed or implied. In no event shall Flothemes (Pixieset Media Inc.) be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use of said products. Some states or jurisdictions do not allow the exclusion of certain warranties. Nothing in this section should be construed as excluding or limiting any warranty beyond what is permissible under applicable law.
9. Theme Support
Flothemes WordPress themes are provided “as is” with no implied meaning that they will function exactly as you wish or with all 3rd party plugins, components and modules. You acknowledge by your use of the themes that it is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with the themes. For an active theme subscription, you receive ongoing updates & free support as long as your subscription is active.
For each one-time theme license, you receive 12 months of free support from the moment of purchase, which is covered in our Support Terms. Any further support is valid either via a subscription model, if active – it will be automatically extended in terms of renewal.
10. Browser Compatibility
Flothemes themes are tested and optimized for the latest 2 versions of most common web browsers. Either way, browser compatibility should be tested against the demonstration themes on Flothemes. Please ensure that the browsers you use will work with the themes as we can not guarantee that Flothemes themes will work with all browser combinations.
11. Miscellaneous Terms
You agree to indemnify and hold Flothemes (Pixieset Media Inc.) harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the themes or this website. Flothemes (Pixieset Media Inc.) reserves the right to change the Terms of Service without notice. Further, Flothemes (Pixieset Media Inc.) reserves the right to modify or discontinue any portion of the membership. Flothemes (Pixieset Media Inc.) shall not be liable to you or any third party should Flothemes (Pixieset Media Inc.) exercise its right to modify, suspend, limit or discontinue any feature its products or services. Use of the themes and this website shall be governed by and construed in accordance with the internal laws of the United States. You agree to submit to the non-exclusive jurisdiction of any United States Federal or State Court, in any action or proceeding arising out of or relating to the use of this website or themes. If any provision of the Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
